Disclaimer version D-001.v1.2026 · Constitution C-2026.05.c
D-001 · Verbatim
EMJ.life provides an evidence layer. Data shown here does not constitute an ESG rating, credit grade, assurance opinion, or investment advice. Downstream disclosure remains the issuer's responsibility under applicable frameworks (IFRS S1/S2, ESRS, GRI, SASB).
This page renders the canonical D-001 text and the constitutional articles that extend it. The same wording is served on every API response envelope under meta.disclaimer_text_en and is enforced in CI by scripts/lint-d001.sh.
What EMJ.life does
- Captures observed behaviour as append-only evidence records (D-021)
- Anchors evidence cryptographically (V-Layer Merkle + OpenTimestamps → Bitcoin)
- Emits artefacts in IFRS S2 / ESRS / GRI / SASB / CBAM-compatible formats — format only (D-024)
- Publishes DOI-anchored disclosure landings via Crossref
- Carries this disclaimer on every API response envelope and every public page
What EMJ.life does not emit
- ESG ratings or risk scores
- Credit grades or counterparty-risk decisions
- Audit / assurance opinions (we are not an assurance provider — D-037)
- Investment advice or recommendations
- Composite governance scores or compliance maturity scores
- Performance signals derived from participation structure (D-023)
Constitutional articles
The D-001 boundary is extended and operationalised by 21 articles. All are immutable; corrections are by compensating append.
- D-001
Non-interpretive
Nothing emitted by EMJ.life constitutes an ESG rating, credit grade, assurance opinion, or investment advice.
- D-020
Identity uniqueness
Every legal subject is identified by the triple (legalIdType, legalIdValue, jurisdictionCode); duplicates are rejected at ingest.
- D-021
Append-only evidence
No UPDATE or DELETE is permitted on b1a, padv, aeu, vlayer, ntcc, doi, or audit_log. Correction is by compensating append.
- D-022
Quality gate only
Validation may reject a record on quality grounds but never disqualifies the participant. The subject remains in good standing.
- D-023
Non-Optimization
Internal value reflects participation structure, not performance. This principle is absolute.
- D-024
Format conformance is not endorsement
Emitting an IFRS S2, ESRS, GRI, or SASB-shaped artefact attests format conformance only and confers no endorsement of the underlying claims.
- D-025
Operator neutrality (from 2026-01-01)
Per S8/D2.19, the operator is structurally neutral: no operator-side interest in any subject's evidence outcome from 2026-01-01.
- D-026
Multi-framework interoperability
Evidence is emitted in shapes compatible with multiple frameworks; no single-framework lock-in is permitted.
- D-027
Cross-system reconciliation
Every record carries an external_ids manifest so that downstream systems can reconcile without re-keying.
- D-028
Timestamp monotonicity
evidence_event_seq is strictly monotonic per subject; anti-rewind guards reject any out-of-order ingest.
- D-029
Subject access rights
Subjects may exercise access via the PET request flow; GDPR erasure is honoured after a documented cooling-off period.
- D-030
Operator-recused mutations
Any back-office change requires a governance_decisions entry; operator self-service mutation is prohibited.
- D-031
ICTF-tier neutrality
EMJ must not expose a public N-tier credibility ladder mapped to NTCC thresholds. Any internal eligibility heuristic remains opaque-to-bank and is not appended to DOI metadata (AUDIT_R5 §2; ICTF v2 §1.2/§2.2/§3).
- D-032
V-Layer-not-clearing
V-Layer publishes evidence records; it does not clear, settle, route, or translate transactions between sovereign systems. SWIFT/VISA-of-ESG framing is prohibited in all papers and marketing (AUDIT_R5 §2; PADV-V-LAYER §1.4/§2.7).
- D-033
Account-freeze prohibition
No EMJ subsystem may auto-freeze, auto-disqualify, or zero an account based on integrity-derived signals. Suspension is INC manual-only with an appeal channel; this extends D-013 / D-022 (AUDIT_R5 §2; STRC v3 §3.2, ICTF v2 l.1534).
- D-034
SFA non-coinage
EMJ does not coin, define, or operate a 'Sustainable Finance Assurance' protocol. Any finance-facing read remains pull-only DOI metadata via Crossref (AUDIT_R5 §2; Op-WP v2 §7.3.4).
- D-035
Tier-6 prohibition
No AI-verified governance tier above L5 may be advertised, schematized, or emitted. The `tier_level` enum is forbidden in code, schema, and public surface (AUDIT_R5 §2; extends R4 retraction list).
- D-036
Op-WP v2 redaction mandate
Prior to PoC (2026-05-30), Op-WP v2 must be re-published as v2.1 with §7.3.4, Basel, and SFA clauses redacted, and its DOI re-minted (AUDIT_R5 §2; Op-WP v2.0). Retracted-DOI pointers MUST be persisted in doi_retractions with status='SUPERSEDED', retracted_at, superseded_by, and a non-interpretive retraction_reason. The retracted DOIs scheduled by R26ζ are: Op-WP v2.0 (10.5281/zenodo.emj-op-wp-v2) → superseded by Op-WP v2.1 (2026-05-20); STRC v3 §3.2 (10.5281/zenodo.emj-strc-v3) → superseded by STRC v3.1 (2026-05-22); ICTF v2 public ladder (10.5281/zenodo.emj-ictf-v2) → superseded by ICTF v2.1 (2026-05-24); PADV-V-LAYER v1 (10.5281/zenodo.emj-padv-v-layer-v1) → superseded by PADV-V-LAYER v1.1 (2026-05-26).
- D-037
Assurance Compatibility
EMJ.life is assurance-compatible, not an assurance provider. Records produced by the evidence layer MUST be consumable by ISAE 3000 / ISAE 3410 / IFRS ISSB assurance procedures without requiring re-keying, but EMJ never substitutes for the assurance opinion. The platform appends evidence; assurance providers append opinions. The two boundaries are non-fungible and never collapsed in code, schema, or public copy.
- D-038
Evidence Integrity Compound
Evidence value compounds across three layers — Participation (C2B), Operational (B2C), and Industrial (B2B). The platform MUST preserve continuity across these layers via external_ids manifest and DOI provenance chain. No layer may be aggregated, averaged, imputed, or otherwise interpolated; doing so would convert evidence into estimate and violate D-001 + D-023.
- D-039
Three-Layer Moat
EMJ's institutional position rests on three non-technical moats: (1) evidence accumulated in real high-entropy scenarios; (2) the knowledge system sealed in DOI whitepapers defining institutional language; (3) institutional authorization tracks (e.g. active engagement with IFRS Foundation / SASB on Level III commercial licence). No product, API, or copy decision may weaken any of these three layers in exchange for short-term feature velocity (see docs/POSITIONING_moat.md).
Retracted DOIs
Whitepapers superseded by a republication. Each row carries a non-interpretive retraction reason and points to the successor DOI.
